At Durkan Ltd, we respect your personal data. This Privacy Notice explains how we will use your personal data when you use our website. What personal data do we collect about you; how do we use that personal data and what is our legal basis?

1. Contact Us/ Development pages

If you chose to contact us using our forms or via email, we will process your name, email, phone and message contents. Our legal basis for this processing is your consent.

2. Property pages

When you make an enquiry about one of our properties, we will need your name, email, phone and your message. You can enter your budget, a moving date and a specific plot, if you choose to do so. We process all of this data with your consent.

3. Marketing

If you have made an enquiry about one of our properties or developments, we will send you information about other properties as we are permitted to do so under the legal basis of legitimate interest. You can unsubscribe from these communications at any time. We can send you marketing information and newsletters when you consent for us to do so. You have the right to unsubscribe to marketing at any time. If you do choose to unsubscribe, we will keep your name and email address on a suppression list so that we don’t email you again by accident.

4. Website and Cookies

When you visit our website, we use Google Analytics to collect standard internet log information (such as your IP/Mac address) and details of visitor behaviour patterns. We do this to find out such things as the number of visitors to the various parts of the site. This information is processed in a way that does not directly identify anyone. We do not make, and do not allow Google to make, any attempt to find out the identities of those visiting our website. We use this data to maintain and monitor the performance of our website and to constantly look to improve the site and the services it offers to our users. The legal bases that we use to process your personal data are either (1) your consent for the optional cookies that we use or (2) legitimate interest for your IP/Mac address eg. in order to maintain the integrity of our IT systems and the continuity of our business.

5. Employment Candidates

When applying for a role you will share a range of recruitment related personal data with Durkan. Your personal data may be shared with us directly by you, or via a third party such as your recruitment agency, to enable the recruitment process. Candidate CVs will be removed after one year of inactivity. Successful candidates will have selected recruitment data transferred to their employee personnel file.

How long do we hold your information for?

We will hold your personal data that we collected to answer your enquiry for one year in case you have any additional enquires and to comply with our business needs. We keep our Google Analytics Reports for 38 months after the last action and then they are destroyed. We will keep you on a suppression list for 7 years and then will remove your personal data. This is to ensure that we don’t send you communications that you don’t wish to receive.

Do we use any automated decision making?

We do not use any automated decision making.

Who do we share your personal data with?

We will not share your information with any third parties for the purposes of direct marketing. We use data processors who are third parties who provide elements of services for us and we have contracts with them. We share your personal data with the following recipients:

  • our software providers
  • cloud service providers
  • website host
  • Outlook/Microsoft
  • Development specific Estate Agents selling on behalf of Durkan

Do we transfer your personal data outside of the EU or EEA?

We do not transfer your personal data outside of the EU.

Your rights

You have rights in respect of our processing your data which are:

  • to access your personal data and information about our processing of it
  • to request a copy of your personal data
  • to rectify incorrect personal data that we are processing
  • to request that we erase your personal data if:
    • we no longer need it
    • if we are processing data by consent and you withdraw that consent
    • if we no longer have a legitimate ground to process your personal data
    • we are processing your data unlawfully
  • to object to our processing if it is by legitimate interest
  • to restrict to our processing if it was by legitimate interest to request that your personal data be transferred from us to another company if we were processing your data under a contract or
  • with your consent and the processing is carried out by automated means
